Welcome to Askitect. These Terms of Services (“Agreement”) explain the rules, rights, and responsibilities that apply when you use our platform, website, and services (collectively, the “Services”). Please read this Agreement carefully before accessing or using Askitect.

By signing up or using Askitect, you acknowledge that you have read, understood, and agreed to this Agreement in full. If you do not agree, you may not use the Services.

1. Overview of Askitect

Askitect is a digital platform designed to assist homeowners, buyers, renters, and real estate professionals in evaluating potential property issues, planning home improvement projects, and receiving general construction-related guidance. Our Services include:

• AI-enhanced analysis of user-submitted photos and descriptions
• Project planning assistance
• Guidance on construction quality, sequencing, and early issue detection

Askitect does not provide physical inspections, regulatory certification, or formal architectural, engineering, or legal services. All guidance is informational and intended to support—not replace—your judgment or that of a licensed professional.

2. Eligibility

You must be at least 18 years old and reside in the United States to use Askitect. By using the platform, you represent and warrant that you meet these requirements.

3. User Responsibilities

When using Askitect, you agree to:

• Submit accurate, lawful, and respectful content
• Use the Services only for personal, non-commercial purposes
• Not misuse, tamper with, or reverse-engineer the platform
• Accept that Askitect is a reference tool, not a substitute for in-person inspections or certified evaluations

4. Use of Askitect’s Services

Askitect helps users interpret visible property conditions, flag potential risks, and understand possible next steps. While our AI is trained on real-world construction data and guided by field expertise, the platform’s feedback is based on limited input and should be considered general reference—not professional advice.

Askitect is not liable for how you use the information provided, and we do not guarantee the accuracy, completeness, or suitability of our responses for any particular purpose.

You agree not to use Askitect’s output in legal disputes, insurance claims, compliance filings, or as a substitute for hiring licensed professionals.

5. Account Creation and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately at info@askitect.com if you believe your account has been compromised.

6. Pricing and Payments

Askitect may offer:

• Pay-Per-Query: A fixed price for each submission (photo or question)
• Subscriptions: Monthly or annual plans with extended access or premium features

All payments are non-refundable except where required by law. We reserve the right to modify pricing and features with prior notice.

7. Information We Collect

To deliver our Services, we collect the following types of information:

a. User-Submitted Content

• Uploaded photos, videos, and images
• Written questions or descriptions
• Optional comments, feedback, or metadata

b. Account and Communication Info

• Name and email (if you register)
• Customer support inquiries

c. Automatically Collected Data

• Browser, device type, IP address
• Usage activity, timestamps, click data
• System logs and AI performance metadata

8. How We Use Your Information

We use your data to:

• Provide accurate, timely, and useful feedback
• Train and improve our AI models
• Respond to customer support requests
• Analyze usage patterns to enhance the platform
• Maintain system security and performance

We may also create anonymized or illustrative examples of user submissions (such as photos or questions) to feature in educational or marketing content. Any use for these purposes will exclude personally identifiable information. Users may request to opt out of this anonymized use by contacting us or through account settings if such functionality is offered in the future.

We do not sell your personal information.

9. Ownership of Data

a. User Content

You retain full ownership of your submitted content, including photos and descriptions (“User Content”). By submitting, you grant Askitect a non-exclusive, royalty-free, worldwide license to process, analyze, and store your content for the purpose of providing and improving the Services.

b. Derived and Aggregated Data

Askitect owns all system-generated outputs, metadata, and usage analytics derived from platform interactions. This includes:

• AI-generated feedback
• Training signals and performance logs
• Aggregated usage patterns
• Anonymized insights

We may use and share this derived data for research, analytics, commercial partnerships, or product development—always in anonymized or aggregated form.

c. Marketing Use

In addition to the rights described above, you grant Askitect a non-exclusive, royalty-free, worldwide license to use anonymized versions of your submitted content for marketing, promotional, and educational purposes. Askitect will not disclose or publish content that could reasonably identify you, your property, or your personal information. Users may request to opt out of this anonymized use by contacting us or through account settings if such functionality is offered in the future.

10. Sharing of Information

We may share anonymized data with trusted partners to improve our platform or develop insights. We may also share limited data with service providers who help us operate (e.g., hosting, analytics), under strict confidentiality obligations.

We will never sell or disclose personal data to third parties for advertising or resale.

11. Data Transfers and Business Changes

In the event of a merger, acquisition, or other business transaction, user data—including content licenses and derived data—may be transferred to the acquiring party. That party will be required to honor this Agreement.

12. Data Security

We use technical and administrative safeguards to protect your information. However, no system is 100% secure, and you acknowledge that you use Askitect at your own risk.

13. Your Rights

You may request to:

• Access, correct, or delete your personal information
• Delete your account entirely
• Request a copy of your data or revoke processing consent (where applicable)

14. Termination

Askitect reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. Upon termination, your right to use the Services ends immediately. You acknowledge and agree that Askitect shall not be liable to you or any third party for any termination of your account or access to the Services. If you have an active subscription at the time of termination, Askitect will refund the unused portion of your subscription on a pro‑rated basis, where appropriate and as required by law.

15. Limitations of Liability

Askitect is provided “as is” and “as available.” We make no warranties of any kind, and to the maximum extent permitted by law, we disclaim all liability for:

• Errors, delays, or omissions in our Services
• Losses or decisions based on platform feedback
• Construction outcomes or third-party contractor performance

You agree to use Askitect as a general reference only, at your own discretion and risk.

16. Indemnification

You agree to indemnify and hold harmless Askitect, its affiliates, officers, and employees from any claim, liability, or expense arising out of your use of the Services or your violation of this Agreement.

17. Dispute Resolution

Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. You waive your right to jury trial or class action participation.

18. Changes to This Agreement

We may update these Terms and Privacy provisions at any time. If changes are material, we will post notice on our site. Continued use of the Services after changes go into effect means you accept the revised Agreement.

19. Messaging Opt-In and Proof of Consent

To receive SMS or messaging communications from Askitect, you must provide express opt-in consent. This consent is collected through a public-facing web form at the time of registration or query submission. The form clearly discloses that by providing your contact information and submitting a request, you consent to receive automated and/or manual replies via text message for the purposes of delivering the Services.

Proof of opt-in is retained and made available via a public and resolvable URL, demonstrating how and where the consumer gave consent. If you have questions regarding this opt-in process or would like to revoke your consent, please email us at info@askitect.com.
